1. By creating a user account or using the Grosint Services confirms your unconditional acceptance of the terms and conditions of this Terms of Service (“ToS”). The Website and the App are jointly referred to as the "Platform" and its usage is referred to as "Service". If you do not agree with these ToS, you should not create an account, or access or use the Platform or any Grosint services for any purpose.

2. The Platform is owned and operated by Garud Research & Tech Pvt Ltd incorporated under the Companies Act, 1956 at RoC-Bengaluru, India. For the purpose of these Terms of Service, wherever the context so requires, "you", “your”, shall mean any natural or legal person who shall use the Platform by providing registration data while registering on the Platform as a registered user using any computer systems. The terms "Grosint", "we", "us" or "our" shall mean Garud Research & Tech Pvt Ltd.

Accounts

3. With respect to creation of account :-

a) You represent and warrant that all information you provide in connection with the creation of an account with our Platform (“Account”) is accurate and true. You agree that, if any Account information changes, you will update your account to maintain accurate information.

b) In connection with Your creation of an Account, you will create a Username and Password (“Credentials”). You agree that you will not distribute your credentials to any other person or entity unless notified to us or granted the access by us. You agree that you will not transfer, sub-license, sell, or assign Your rights in your account to any other person or entity.

c) Grosint reserves the right to terminate your account at any time for any reason. If your account is terminated, Grosint has no obligation to retain any data associated with your account.

Limitations of Use

4. This service is intended for Law Enforcement Agencies, Investigative agencies or individuals who work for, or assist law enforcement agencies in India. You may use our services for lawful purposes only. You may not use our services in any manner that

a) is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, or otherwise objectionable.

b) encourages conduct that would constitute a criminal or other offense. The information obtained from Grosint is not admissible in Court of law.

Responsibilities

5. When requesting for information, the User who is a Government Official is authorizing "Grosint" to access and provide required information which can be public as well as personal data.

(a) The User Government Official is responsible for obtaining consent of the individual whose details are being obtained via "Grosint" (applicable if such consent is required under the circumstances of the investigation or case).

(b) The User Government Official is responsible for his own intent, conduct and for following laid down procedures as per the Law, when exercising his/her powers under section 17(c) of Digital Personal Data Protection Act 2023, which exempts the state (Government of India as defined in Article 12 of the Constitution), its agencies & its officials from obtaining suspect's consent for requesting/accessing his/her personal data for lawful reasons/purposes such as ensuring sovereignty, integrity of India, National Security, maintaining public order or to prevent crime including cyber offences).

Information (or) Data

7. On receiving request from a Government Official Grosint may aggregate available information, from the internet (surface web, deep web, darkweb, social networks or other third party sources). The information provided “as is” or “as available”. We do not evaluate each piece of information provided and make no guarantee about the accuracy, legitimacy, or legality of any information or how recently any information was collected or updated. You agree that there are no warranties or guarantees whatsoever regarding the information provided. Further, you agree to rely on the information available at your own risk. The Public Information may include photos obtained from social network profiles. We take no responsibility for these photos.

Indemnity

8. You agree to hold harmless and indemnify Grosint, its directors, employees, its vendors, and their respective directors, officers, employees and agents from and against any third party claim arising from or in any way related to your use of the Service, violation of these ToS or any other actions connected with use of our services, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature. In such a case, Grosint will provide you with written notice of such claim, suit or action.

No Liability

9. In no event will Grosint, its officers, directors, employees, affiliates, successors or assignees be liable to any party (i) for any indirect, direct, special, consequential, incidental, exemplary, special, or punitive damages even if advised of the possibility of such; (ii) loss of business, profits, business information, or business interruption, or any other pecuniary loss. Grosint reserves the right, at any time, in Grosint’s sole and exclusive discretion, to amend, modify, suspend, or terminate any services, information or content, or any part thereof, and/or your use of or access to them, with or without notice. Grosint shall have no liability to you or any other person or entity for any modification, suspension, or termination, or any loss of related information.

Warranty

10. With respect to warranty:-

a) Your use of Grosint services is at your sole risk (including but not limited to any damage to your computer system, loss of data, damage resulting from reliance on information from Grosint, or other damages that result from obtaining any content from the website including computer viruses) even if Grosint has been advised of or is aware of the risk of such damage. The information and the content prodvided “as is,” “as available,” and “with all faults,” without warranty of any kind, and Grosint specifically disclaims all warranties and conditions, express or implied, including but not limited to the implied warranties and/or conditions of merchantibility, fitness for a particular purpose, or noninfringement.

b) No information or advice provided on Grosint, by Grosint, or by Grosint’s employees or agents shall create any warranty.

c) Grosint makes no warranty, representation, covenant, or guarantee whatsoever, express or implied.

i) As to the value, quality, timeliness, usefulness, reliability, security, suitability, truthfulness, or completeness of Grosint, the services, the information, or the content that Grosint will operate uninterrupted or error-free.
ii) That Grosint, the services, the information, or the content will meet your needs or expectations.
iii) As to the quality or value of any of Grosint’s products, services, content, information, or other material you purchase or obtain via the website that any errors on Grosint will be corrected.
